There are a number of routes to achieving Indefinite Leave to Remain status in the UK. The main routes are as follows:
- Indefinite Leave to Remain as the spouse of a settled person – this is a common route for achieving settlement in the UK. If you arrived in the UK under the Rules in place prior to 09th July 2012, you will be able to apply for Indefinite Leave to Remain if you are still in the partner category. The minimum residence requirement is 2 years in such cases. If you arrived in the UK after 09th July 2012, you are entitled to apply for Indefinite Leave to Remain in the UK under this route once you have achieved a minimum residence of 5 years in the UK under the partner category.
- Long Residence – you can apply for Indefinite Leave to Remain in the UK under the long residence route if you have been legally resident in the UK for a continuous period of 10 years. This can be through a combination of different categories.
- Tier 2 ILR – you may be eligible to apply for Indefinite Leave to Remain in the UK after a continuous period of 5 years residence in the UK under the Tier 2 scheme.
